Compensation provided to victims of Duhail explosion far below Labour Law standards

Following the announcement of QR30,000 as compensation for the three Indian employees who died in the Duhail explosion last week, the Indian Embassy has decided to lodge a complaint against the restaurant management to seek greater compensation for the deceased.

However, the Nepali Embassy is yet to take action. An official from the embassy told JustHere, “We do follow the Qatar Labour Law for labour-related issues. This matter will have to be investigated.”

According to the Qatar Labour Law 2004, the kin of an employee who dies in Qatar while “either being at work or in the course of work” is entitled to receive an insurance compensation of QR200,000, but only if the deceased was insured by the company. In the case of the workers in the restaurant, none of them were insured, says a report in Gulf Times. Hence, the restaurant operators agreed to offer a compensation of only Rs500,000 (approximately QR30,000) to each of the three Indian workers, and Rs500,000 each (approximately QR19,200) to each of the four Nepalese workers.

However, Nizar Kocherery , legal and rights activists, in a statement to the daily, said: “It is the legal responsibility and moral obligation of the employer (sponsor) to provide the compensation amounting to a minimum of QR200,000 to the kith and kin of the deceased if the employee did not enjoy insurance coverage at the time of his death.”

The explosion that took place on February 27, 2014 at the Istanbul restaurant in the petrol station complex next to Landmark mall, killed 12 people and injured 31.
